Terms of Service

Lydoh answers inbound telephone calls to a number you connect, responds to callers using content you supply, captures requests, and — where enabled — routes urgent after-hours calls to your on-call staff. It is a communications and message-capture tool. It is not a medical device, a clinical decision system, a nurse-triage line, or an emergency service.

You must be at least 18 and authorized to bind your organization. You sign in to your Lydoh account with Google, an emailed link or a password; you are responsible for all activity under your credentials and API keys, and for keeping them confidential. Notify us promptly of any suspected compromise.

The service is offered at the monthly price published on the pricing page for the plan you choose (practice plans from $49 per month), or the price on your subscription if it began on an earlier plan, billed in advance and renewing automatically until cancelled. New accounts may receive a 14-day free trial; unless you cancel before it ends, the subscription converts to paid. Practice plans that include voice answering include a monthly allowance of voice minutes, shown on the pricing page for each plan. Minutes past the allowance in a billing period are charged at $0.25 per minute (or the per-minute rate then published for your plan), billed after the period ends.Payments are processed by Stripe. Fees are non-refundable except where required by law. You may cancel at any time, effective at the end of the current billing period. We may change pricing on 30 days' notice before your next renewal.

You control what the assistant says and who it serves. You are responsible for:

• The accuracy and lawfulness of the knowledge-base content, greetings, and prompts you provide.
• Obtaining any consent and providing any notices your jurisdiction requires from your callers — including call-recording disclosure (see §5) and, where applicable, HIPAA notices.
• Configuring business hours, transfer numbers, and on-call rotations correctly, and monitoring the requests the service captures.
• Not using the service for emergency dispatch, clinical advice, or as a substitute for staff where a person is legally required.

The service may record and transcribe calls so you can review them. Recording laws vary. Some jurisdictions require the consent of every party to a call. You are solely responsible for determining what disclosure or consent applies to your callers and for ensuring your greeting and practices provide it. We give you the ability to customize your greeting for this purpose; we do not provide legal advice on it.

You will not use the service to:

• Place or facilitate unlawful, harassing, deceptive, or unsolicited automated calls (including violations of the TCPA or comparable law).
• Impersonate another person or organization, or misrepresent the assistant as a human when asked directly.
• Collect payment-card numbers, government identifiers, or sensitive data the service isn't designed to handle.
• Attempt to breach, overload, reverse-engineer, or circumvent access controls or rate limits.

The Acceptable Use Policy at /acceptable-use sets out these rules in full and forms part of these terms. We may suspend service for conduct that violates this section or that policy, or that creates risk for us or others.

On a personal line, the assistant places outbound calls that you ask it to place. It identifies itself as a digital assistant calling on your behalf, and it will not make payments, give out card or bank details, or complete identity verification. You are responsible for the instructions you give it, including who it calls and what it asks for, and for confirming any booking that matters directly with the business. The assistant can mishear and a business can make a mistake, so we do not guarantee the outcome of any call. Outbound task calls are subject to the monthly allowance, calling window, and retry limits published for your plan.

A practice may use Lydoh to text people who called or texted the practice: confirmations of their requests, appointment reminders, replies from the front desk and review requests. Texts are not used for promotions. Every text names the practice. Message frequency varies; message and data rates may apply. Recipients can reply STOP to stop all texts from that number and HELP for help; an opt-out is honoured for every text from that number. US carriers require each practice to register before texting; the practice must give accurate business details for that registration and is responsible for the content of texts its staff write.

The assistant is an automated system. It answers from the content you supply and can make mistakes, mishear, or fail to capture a call. It does not book confirmed appointments on its own, does not give medical advice, and must not be relied on as the sole channel for urgent matters. You are responsible for human review of captured requests and for maintaining an alternative path for emergencies.

As between us, you own the content you supply and the call data generated for your account. You grant us a limited licence to process it to operate and support the service. Our handling of personal information is described in the Privacy Policy; where we process protected health information for a covered entity, a Business Associate Agreement governs and controls over any conflicting term here.

The service depends on third parties including telephony, speech, and AI model providers (listed on our Security & Compliance page). Their outages, number-porting rules, and carrier behavior are outside our control. Telephone numbers provisioned for you may be subject to carrier requirements and are not guaranteed to be portable.

We work to keep the service available but do not promise uninterrupted operation. We may modify, suspend, or discontinue features, and will give reasonable notice of material adverse changes where practicable. Maintenance, carrier incidents, and third-party failures may interrupt call handling.

Except as expressly stated, the service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that calls will be answered, captured, transcribed, or escalated without error or interruption.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service will not exceed the fees you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions; in those places these limits apply only to the extent permitted.

You will defend and indemnify us against third-party claims arising from your content, your callers, your failure to obtain required consents or provide required notices, or your violation of these terms or applicable law.

You may cancel at any time. We may suspend or terminate for material breach, non-payment, or unlawful use. On termination, access ends and we delete or return your data as described in the Privacy Policy. Sections that by nature survive (ownership, disclaimers, liability, indemnity, governing law) survive.

We may update these terms; the “last updated” date above reflects the current version. Material changes will be notified by email or in the dashboard. Continued use after they take effect means you accept them.

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules, and the parties submit to the exclusive jurisdiction of the courts located there.
